These terms of sale define the conditions under which LE DOMAINE DE MYLESIA offers and provides services to customers.

2. Scope

These terms of sale apply, unless contrary written special terms are agreed, to services offered by LE DOMAINE DE MYLESIA under the name Domaine de l’Horloge.

They may cover in particular:

  • accommodation services;
  • food service;
  • leisure activities;
  • event services;
  • private hire;
  • rental or provision of equipment;
  • ancillary services offered to customers.

These terms apply to consumer customers and, where relevant, professional customers, subject to any special terms agreed between the parties.

Any booking, order or approval of a quotation implies full and unconditional acceptance of these terms of sale.

3. Services offered

The services offered are described on the website, in commercial documents, quotations, written exchanges, booking confirmations or booking platforms used by LE DOMAINE DE MYLESIA.

Photographs, illustrations, texts, descriptions, opening hours, capacities, availability, equipment and information published on the website are provided for guidance only and may be changed at any time.

Only information confirmed in writing by LE DOMAINE DE MYLESIA at the time of booking or ordering is contractual.

4. Booking and order

The customer may make a booking or order request in particular:

  • by telephone;
  • by email;
  • through the website;
  • via a contact form;
  • via a partner booking platform;
  • directly with LE DOMAINE DE MYLESIA.

A booking or order becomes final only after written confirmation by LE DOMAINE DE MYLESIA and, where applicable, after payment of the deposit, advance payment, security deposit or agreed price.

Where a third-party booking or payment platform is used, the terms of that platform may apply in addition to these terms of sale.

5. Quotations and personalised offers

Certain services, including events, private hire, groups or specific requests, may be subject to a personalised quotation.

The booking is deemed final after written acceptance of the quotation by the customer and payment of the sums requested at booking.

Any change requested by the customer after acceptance of the quotation may result in an adjustment to the price, deadlines or performance conditions.

6. Prices

Prices are stated in euros, inclusive of applicable taxes where relevant.

Prices may vary according to period, availability, duration, number of people, options, selected services, events, special terms or booking platforms used.

Prices displayed on the website are for guidance only and may be changed at any time. The applicable price is the one confirmed to the customer at the time of booking or ordering.

Taxes, additional charges, deposits, security deposits, options, additional services or possible tourist tax are specified before booking confirmation where applicable.

7. Payment

Accepted payment methods are:

In the event of late or failed payment, LE DOMAINE DE MYLESIA reserves the right to suspend or cancel the booking or service after informing the customer.

8. Security deposit

For certain services, particularly accommodation, equipment rental, private hire or events, a security deposit may be requested.

The security deposit may be retained in whole or in part in the event of damage, loss, breakage, exceptional cleaning, non-compliance with rules of use or outstanding sums due by the customer.

9. Performance conditions

The customer undertakes to comply with opening hours, safety instructions, capacities, rules of use, neighbourhood rules, health rules, access conditions and instructions communicated by LE DOMAINE DE MYLESIA.

The customer is responsible for the conduct of accompanying persons, including minors.

Any non-compliant, dangerous, abusive or contrary use may result in immediate interruption of the service without refund, without prejudice to any amounts that may be claimed as compensation for damage suffered.

10. Cancellation or modification by the customer

Cancellation and modification conditions depend on the booked service, period, remaining time before the scheduled date and special terms communicated to the customer.

Unless different special terms are confirmed in writing, the following rules apply:

Any request to change the date, time, number of people, service or option is subject to the prior agreement of LE DOMAINE DE MYLESIA and availability.

Additional charges may apply in the event of modification.

11. Cancellation or modification by LE DOMAINE DE MYLESIA

LE DOMAINE DE MYLESIA may have to modify or cancel a service in the event of force majeure, exceptional unavailability, adverse weather conditions, safety requirements, technical problems, administrative decisions, health issues, impossibility of operation or an event beyond its control.

In such case, LE DOMAINE DE MYLESIA will, where possible, offer a postponement, an equivalent service or a refund of the sums paid for the service not provided.

No additional compensation may be claimed, unless mandatory law provides otherwise.

12. Right of withdrawal

Under Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply in particular to accommodation services other than residential accommodation, catering or leisure activities that must be provided on a specific date or during a specific period.

Consequently, for dated accommodation, catering, events, leisure activities or activities, the customer does not benefit from a 14-day withdrawal period.

For undated services or sales not covered by a legal exception, the consumer customer may benefit from a right of withdrawal under the conditions provided by the French Consumer Code, unless the service has been fully performed before the end of the withdrawal period with the customer’s prior express agreement and express waiver where permitted by law.

13. Gift vouchers, credits and gift cards

If LE DOMAINE DE MYLESIA offers gift vouchers, credits or gift cards, their validity, use, refund and extension conditions are indicated at the time of purchase.

14. Customer liability

The customer is responsible for:

  • the accuracy of information provided;
  • compliance with schedules;
  • compliance with safety instructions;
  • respect for premises, equipment and materials;
  • conduct of persons participating in the service;
  • damage caused by the customer or accompanying persons.

The customer must compensate LE DOMAINE DE MYLESIA for any damage, loss, breakage, deterioration, theft, exceptional cleaning, disturbance or harm caused by the customer or persons for whom they are responsible.

15. Liability of LE DOMAINE DE MYLESIA

LE DOMAINE DE MYLESIA is responsible for proper performance of confirmed services under the conditions provided by law and these terms of sale.

Its liability cannot be incurred in the event of:

  • customer fault;
  • fault of a third party;
  • unforeseeable and insurmountable event;
  • force majeure;
  • non-compliance with instructions;
  • inappropriate use of premises, equipment or materials;
  • damage resulting from inaccurate information provided by the customer.

16. Insurance

LE DOMAINE DE MYLESIA declares that it is insured for the activities it operates, within the terms and limits of its insurance contracts.

The customer is invited to check that they have appropriate personal insurance, particularly for accommodation, events, leisure activities, water activities or use of equipment.

17. Complaints

Any complaint must be sent in writing to:

The complaint must specify the customer’s identity, the date of the service, the service concerned, the reason for the complaint and any useful supporting documents.

LE DOMAINE DE MYLESIA will endeavour to respond within a reasonable time.

18. Consumer mediation

In accordance with the applicable provisions of the French Consumer Code, consumers have the right to use a consumer mediator free of charge to seek an amicable resolution of a dispute with a professional.

Before referring the matter to a mediator, the consumer must first send a written complaint to LE DOMAINE DE MYLESIA.

LE DOMAINE DE MYLESIA is in the process of appointing a consumer mediator with:

19. Personal data

Personal data collected in connection with bookings, orders, contact requests, quotations, invoices or exchanges with the customer is processed in accordance with the website privacy policy.

20. Force majeure

Neither party shall be liable for a failure to perform its obligations where such failure results from a force majeure event under French law.

Force majeure or events preventing normal performance may include severe weather, natural disaster, fire, flood, health crisis, administrative decision, access ban, interruption of essential services, major breakdown, accident, safety event or any external, unforeseeable and irresistible event.

21. Applicable law

These terms of sale are governed by French law.

In the event of a dispute with a consumer, statutory jurisdiction rules apply.

In the event of a dispute between professionals, unless mandatory provisions provide otherwise, jurisdiction may be granted to the competent courts of the registered office of LE DOMAINE DE MYLESIA.

22. Acceptance of the terms of sale

The customer acknowledges having read these terms of sale before any booking or order.

Confirmation of a booking, quotation, order or full or partial payment for a service constitutes unconditional acceptance of these terms of sale.
